USE & SALE.

The rules around using the site, ordering a limited-release garment and carrying somebody else’s artwork into the world.

AGREEMENT & WHO WE ARE

These Terms of Use & Sale (Terms) apply when you access flashsupply.co, interact with our online store or purchase products from FLASH SUPPLY CO. PTY LTD (Flash Supply Co., we, us or our). By using the site or placing an order, you agree to these Terms together with our Privacy Policy and Shipping & Returns Policy.

If you are purchasing on behalf of another person or organisation, you confirm that you have authority to do so. You must provide accurate, current information when ordering.

ORDERS, PRICING & PAYMENT

Prices are displayed in Australian dollars unless the storefront expressly states otherwise. Australian prices include applicable GST where required. Shipping, duties, taxes or other destination charges may be added at checkout or imposed by authorities in the destination country.

Submitting an order does not require us to accept it. We may reject or cancel an order before fulfilment where reasonably necessary, including for suspected fraud, pricing or listing errors, duplicate orders, payment problems, product or production unavailability, misuse of promotions, or an inability to deliver to the supplied address. If we cancel a paid order in those circumstances, we will refund the amount paid for the cancelled item or order.

Obvious typographical, pricing or technical errors do not require us to supply a product at an incorrect price where it would be unreasonable to treat the displayed information as genuine.

LIMITED RELEASES & MADE-TO-ORDER PRODUCTION

Unless stated otherwise, Flash Supply Co. garments are produced after an order is placed. Production begins quickly and may be performed by specialist third-party production and fulfilment partners. Once production has commenced, changes or cancellations may no longer be possible.

A drop, collection, design, colour or garment may be withdrawn, closed or archived at any time. References to a design being limited, archived or not reprinted describe our intended release model, but do not create an obligation to maintain any particular resale value, scarcity level or secondary-market price.

We may make reasonable production changes where a blank, process or component becomes unavailable, provided the resulting product is not materially different from what you purchased. If a material change is necessary, we will contact you where reasonably practicable.

PRODUCT APPEARANCE, SIZING & CARE

Product photography and mock-ups are intended to represent each piece as accurately as reasonably possible. Screen settings, garment washing, dye lots, distressing, mineral or vintage washes, hand-frayed details, print placement and the characteristics of individual blanks can cause minor variation. Those ordinary variations are part of the garment and are not defects unless the product fails to meet a consumer guarantee.

Measurements and size guides are provided to help you choose a size, but garment measurements can vary within ordinary manufacturing tolerances. You are responsible for checking the product-specific size guide before ordering. A preference for a different fit, where the supplied item matches the size ordered and is not faulty, is treated as change of mind.

You are responsible for following the care instructions supplied on the product page or garment. Damage caused by misuse, alteration, inappropriate washing or drying, failure to follow care instructions, normal wear and tear or accidental damage is not a manufacturing defect.

PRODUCTION, SHIPPING & DELIVERY

Production and shipping estimates are estimates, not guaranteed delivery dates, unless we expressly agree otherwise in writing. Delivery can be affected by production queues, carriers, customs, severe weather, public holidays, address issues and events outside our reasonable control.

You must provide a complete and accurate delivery address. If an order is returned, delayed or lost because the address supplied was incorrect or incomplete, additional shipping charges may apply to resend it where permitted by law.

Risk in a product passes to you when it is delivered to you or a person authorised by you to receive it, subject to rights that cannot lawfully be excluded. Full current details are set out in our Shipping & Returns Policy.

RETURNS, FAULTS & AUSTRALIAN CONSUMER LAW

Because our pieces are generally produced specifically for each order, we do not generally offer a return, refund or exchange for a correctly supplied item solely because you changed your mind, selected the wrong size or colour, or no longer want the product.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law. If a product is faulty, damaged, materially misprinted, incorrectly supplied or otherwise fails to meet a consumer guarantee, contact us promptly at info@flashsupply.co with your order number and clear photographs. Depending on the circumstances and applicable law, remedies may include repair, replacement, refund or another remedy.

We may ask you to retain the product, provide photographs or return it so the issue can be assessed. We will not require you to waive a statutory right as a condition of receiving a remedy you are legally entitled to.

ARTISTS, ARTWORK & INTELLECTUAL PROPERTY

Flash Supply Co. is built around independent artists. Artwork featured on the site and garments remains protected by copyright and other intellectual-property rights belonging to the relevant artist, Flash Supply Co. or their respective licensors. Purchasing a garment gives you ownership of that physical garment; it does not transfer copyright or grant a licence to reproduce, digitise, trace, scrape, train on, adapt, mint, commercially exploit, manufacture from or otherwise reuse the artwork.

You may not copy product graphics, artist artwork, photographs, copy, branding, logos, page designs or other site content for commercial use without written permission from the relevant rights holder. You may share ordinary links to our public pages and personal photographs of products you own, provided you do not falsely imply endorsement, authorship or affiliation.

Artist names, social profiles, studio details and external booking links are provided for attribution and discovery. Unless expressly stated otherwise, Flash Supply Co. is not the tattoo studio, booking agent or service provider for an artist’s independent tattoo services.

ACCEPTABLE USE OF THE SITE

You must not misuse the site, interfere with its operation, attempt unauthorised access, introduce malicious code, impersonate another person, conduct fraudulent transactions, use automated systems to place abusive orders, or scrape the site at scale for commercial replication, model training, dataset creation or competitive cataloguing without our written consent.

We may restrict access, cancel abusive transactions or take reasonable protective steps where we reasonably believe the site, our customers, artists, intellectual property or business are being misused.

THIRD-PARTY SERVICES & LINKS

The store uses third-party services including Shopify, payment processors, production partners, carriers and social platforms. External links, including Instagram and artist booking links, take you to services we do not control. Their availability, content, privacy practices and independent services are governed by their own terms.

We remain responsible for our obligations to you as the retailer where applicable; the use of a fulfilment, payment or technology provider does not remove any non-excludable consumer rights.

DISCLAIMERS & LIABILITY

To the maximum extent permitted by law, we do not guarantee that the website will always be uninterrupted, error-free or available, and we are not responsible for loss caused solely by third-party outages, malicious attacks or events outside our reasonable control.

Where the law permits us to limit liability, we exclude liability for indirect or consequential loss that was not reasonably foreseeable at the time of purchase. Nothing in this clause limits liability or remedies to the extent doing so would be unlawful, including liability that cannot be excluded under the Australian Consumer Law.

Any information about artists, garments, fit, creative practice or styling is general information only and is not professional medical, tattoo aftercare, legal or other specialist advice.

CHANGES, GOVERNING LAW & CONTACT

We may update these Terms from time to time. The version displayed when you place an order will generally apply to that order, except where a change is required by law or benefits you. If any provision is invalid or unenforceable, the remaining provisions continue to operate to the extent permitted by law.

These Terms are governed by the laws of Victoria, Australia. You and Flash Supply Co. submit to the courts and tribunals having jurisdiction in Victoria, subject to any consumer right to bring a claim elsewhere that cannot lawfully be restricted.
